Welcome to Laetitia Demay's wearable art collection. These Terms of Sale govern all purchases made through this website. By placing an order, you agree to be bound by these terms.

These Terms of Sale apply to all orders placed on this website. By completing your purchase, you acknowledge that you have read, understood, and accepted these terms.

2. Products & Prices

All prices are clearly displayed on each product page and include all applicable taxes except where stated otherwise.

Important Notes:

• Prices are subject to change without notice
• The price applicable is the one displayed at the time you place your order
• Customs duties and import taxes (if applicable) are the buyer's responsibility
• Shipping fees are additional and calculated at checkout (see Shipping Policy)

3. Ordering Process

How to Order:

1. Browse the collection and select your desired item(s)
2. Click "Add to Cart" and review your order
3. Proceed to checkout and provide delivery information
4. Complete payment through our secure PayPal gateway
5. Receive order confirmation by email

Order Validation: Your order becomes a binding contract when:

• You click "Validate Order" or "Complete Purchase"
• Payment is successfully processed
• You receive an order confirmation email

Please verify all information carefully before validating your order. If you notice an error after placing your order, contact us immediately via WhatsApp.

4. Payment

Payment Method: We accept secure payments through PayPal, which allows you to pay with:

• PayPal balance
• Credit cards (Visa, Mastercard, American Express)
• Debit cards
• Bank accounts (where available)

Security: All payment transactions are processed through PayPal's secure encrypted platform. We do not store your credit card information on our servers.

Payment Processing:

• Full payment is required at the time of order
• Orders are processed only after payment confirmation
• Payment authorization may be checked before shipment

Payment Issues: If payment fails, your order will not be processed. You may attempt payment again or contact us for assistance.

5. Delivery & Shipping

Key Points:

• Morocco: 3-5 business days
• International: 7-21 business days depending on destination
• Free Shipping: On orders of 3+ items (all destinations)
• Tracking: Provided by email once your order ships

Delivery Address: Ensure your shipping address is complete and accurate. We are not responsible for delays or non-delivery due to incorrect addresses provided by the customer.

Customs & Import Duties: For international orders, you may be subject to customs duties, import taxes, or fees imposed by your country. These charges are your responsibility and are not included in the product price or shipping fee.

6. Right of Withdrawal (EU & UK Consumers)

If you are a consumer located in the European Union or United Kingdom, you have a legal right to withdraw from your purchase within 14 calendar days without providing any reason.

Withdrawal Period: 14 days from the date you (or a third party you designate) receive the item.

How to Exercise Your Right:

• Clearly state your decision to withdraw
• You may use our Return Policy form or send your own statement

Return Conditions:

• Item must be unworn and unwashed
• Original packaging and tags must be intact
• Return shipping costs are your responsibility (unless item is defective)

Refund: We will refund all payments received from you (excluding return shipping costs) within 14 days of receiving the returned item or proof of return shipment.

7. Returns & Exchanges (Non-EU/UK)

For customers outside the EU/UK, we offer a voluntary 14-day return policy under the same conditions described above. See our Return Policy for full details.

Exchanges: Subject to stock availability. Contact us to arrange an exchange.

Non-Returnable Items:

• Items that have been worn, washed, or altered
• Items without original tags or packaging
• Items damaged by the customer

8. Product Quality & Warranties

Quality Commitment: Each wearable art piece is carefully handcrafted and inspected before shipment. We are committed to delivering high-quality products.

Legal Warranties:

• Conformity: Products must conform to the description provided
• Merchantability: Products must be fit for their normal purpose
• Fitness for Purpose: If you specified a particular use, products must be suitable for that use

Defective Items: If you receive a defective or damaged item:

• Contact us immediately via WhatsApp with photos
• We will arrange a replacement or full refund (including shipping)
• Return shipping for defective items is at our expense

Care Instructions: To maintain the quality of your wearable art:

• Follow care instructions provided with your item
• Hand wash in cold water when needed
• Avoid harsh chemicals or bleach
• Lay flat to dry

9. Intellectual Property

All artwork designs, photographs, and content on this website are protected by copyright and belong exclusively to Laetitia Demay.

Your Rights as a Buyer:

• You may wear and enjoy your purchased item
• You may take personal photographs featuring the item
• You may resell the physical item as a used good

Restrictions:

• You may not reproduce, copy, or create derivative works from the designs
• You may not use the designs for commercial purposes
• You may not claim the designs as your own

10. Limitation of Liability

To the fullest extent permitted by law:

We are liable for:

• Product defects and non-conformity
• Personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any other liability that cannot be excluded by law

We are not liable for:

• Delays caused by shipping carriers or customs
• Customs duties or import taxes
• Delivery issues due to incorrect addresses you provided
• Normal wear and tear of products after use
• Damage caused by failure to follow care instructions

Maximum Liability: In no event shall our total liability exceed the purchase price of the item(s) in question.

11. Force Majeure

We shall not be liable for any delay or failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:

• Natural disasters
• War, terrorism, or civil unrest
• Government actions or regulations
• Pandemics or epidemics
• Strikes or labor disputes
• Shipping carrier disruptions
• Internet or technology failures

In such cases, we will notify you as soon as possible and make reasonable efforts to fulfill your order.

EU Online Dispute Resolution: EU consumers may use the ODR platform at https://ec.europa.eu/consumers/odr

Arbitration (International Customers): If good faith negotiation fails, disputes may be resolved through binding arbitration in accordance with international commercial arbitration rules.

Consumer Rights: Nothing in these terms affects your statutory consumer rights under mandatory local laws.

14. Governing Law & Jurisdiction

Applicable Law:

• These Terms are governed by Moroccan law
• International transactions may be subject to the Vienna Convention on Contracts for the International Sale of Goods (CISG)
• Mandatory consumer protection laws in your jurisdiction may also apply

Jurisdiction:

• Disputes shall be subject to the competent courts in Morocco
• EU/UK consumers may bring claims in their country of residence
• Consumers in other jurisdictions retain rights under local law

We may update these Terms of Sale from time to time. The version in effect at the time you place your order will govern your purchase.
